These Terms are a binding agreement. They include disclaimers and a limitation of liability, and they explain that our software is a tool to support your work — not a substitute for professional compliance, legal, or clinical judgment. If you don't agree, don't use the Services.
These Terms of Service ("Terms") govern your access to and use of the website, products, and services of BH Growth Engine LLC ("BHGE," "we," "us"). By accessing the site or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
BHGE provides software tools and related services for behavioral health treatment centers, including our marketing website and products such as BH SEO Intel. Specific paid products may be governed by an additional order form, subscription, or product-specific terms, which supplement these Terms; if there is a conflict, the product-specific terms control for that product.
The Services are for business use by treatment center operators and their authorized personnel. You must be at least 18 and able to form a binding contract. You may not use the Services if you are barred from doing so under applicable law.
For Services that require an account, you are responsible for the accuracy of your account information, for maintaining the confidentiality of credentials, and for all activity under your account. Notify us promptly of any unauthorized use.

You are responsible for your own regulatory compliance. The Services may help you produce, schedule, or analyze content, but you are solely responsible for reviewing and approving all content before it is published and for ensuring it complies with LegitScript, HIPAA, 42 CFR Part 2, FTC rules, platform policies, and applicable federal and state laws. You represent that you have the rights and consents necessary to connect any accounts or data you provide to the Services, and to authorize the actions you direct the Services to take.
The Services may interoperate with third-party platforms (for example, Meta, Google, or an electronic medical record). Your use of those platforms is governed by their own terms, and we are not responsible for their acts, omissions, availability, or changes. We may modify or discontinue an integration if a platform changes its terms or access.
The Services, including all software, designs, and content we provide, are owned by BHGE or its licensors and are protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes. Content you submit remains yours; you grant us the limited license needed to operate the Services and provide them to you. We may use aggregated, de-identified data to operate and improve the Services.
Browsing the marketing website is free. Paid Services are billed as described at purchase or in the applicable order or subscription. Unless stated otherwise, fees are non-refundable, and you authorize us to charge your payment method on a recurring basis until you cancel. We may change pricing prospectively with notice.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted or error-free, or that any particular marketing, admissions, or census outcome will result from their use. The Services do not provide legal, compliance, or clinical advice, and are not a substitute for review by qualified professionals.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE APPLICABLE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will defend, indemnify, and hold harmless BHGE from claims, damages, and expenses arising out of your content, your use of the Services, your violation of these Terms, or your violation of any law or third-party right, including any regulatory claim relating to content you approved for publication.
These Terms apply while you use the Services. You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or to protect the Services or other users. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification. On termination, data handling follows the Data Handling & Deletion page.
These Terms are governed by the laws of the State of [Georgia], without regard to conflict-of-laws rules, and the state and federal courts located there will have exclusive jurisdiction, unless a signed order form states otherwise. We may update these Terms; material changes will be posted here with a new effective date, and continued use after changes means you accept them.
